A worker assembles a box for delivery at the Amazon fulfillment center in Baltimore, Maryland, US, April 30, 2019.that Amazon is legally liable for defective products sold on its site by third parties.
The decision overturned an earlier ruling from a trial court in favor of Amazon's motion for a summary judgment, though the company can still appeal to the state's Supreme Court. Amazon did not immediately respond to a request for comment. But the court disagreed, finding that Amazon played such an outsized role in the transaction that it bore the responsibility for the defective battery.
The court also didn't buy Amazon's statement that it should be protected under section 230 of the Communications Decency Act of 1996, which shields internet companies from legal repercussions for content published by third parties on their sites.
Was about time!
That’s a ridiculous ruling, which will never hold in the Supreme Court, as Amazon clearly states it is a Broker/Middleman & is not a guarantor of Seller’s products. Whomever is on the Ca App Ct, needs 2 go back 2 Law School & get their $ Back.
'The ruling potentially opens them up to significant legal exposure from other customers who could bring similar lawsuits for faulty or damaged products. It could also force Amazon to adjust its policies to more tightly regulate third-party sellers' Time to get my hopes up! 🤡
So I guess we can start suing Facebook for what Russia posts?
Hate to be eBay where most items are defective or country
This is going to be a massive pain in the ass for 3rd party sellers.
They should be. I have bought several car parts advertised as fitting my car and they do not, then sellers say they’re generic and pressure me to spend time trying to make them work. After I complain and want to return Amazon let’s them do the same to others.
Yes!
Why is California so F’d up?
