A review of the Small Business Fair Dismissal Code has recommended an overhaul to reduce the number of employers paying thousands in mediation to settle claims.

Small Business Ombudsman Kate Carnell says the current code is not fit for purpose with employers often forced to pay 'go away' money so a case doesn't progress to court.

Ms Carnell wants a dedicated small business division to be established within the Fair Work Commission aimed at dealing with claims made against small business employers. The division would appoint case managers and assess claims at an early stage.
